Abstract: There is no authoritative definition of illegal building in chinese laws. The definition of academics and competent administrative department of construction has some problems. Basing on the positive analysis of the system of construction, such as the planning permission, the permission for land use, the construction permit, and related approval system, the definition of illegal building can be practical and manipulative .Dispose of Illegal Construction Act should be enacted in China.The illegal construction and unauthorized construction will be unanimous,and the illegal construction should be the formal legal term.The illegal construction should be difined in the Act.
